2005 Maine Code - §402 — Definitions


    As used in this Code, unless the context indicates otherwise, the following terms have the following meanings. [1983, c. 460, § 3 (new).]

      1. Accuser. "Accuser" means a person who:
   
A. Signs and swears to charges; [1983, c. 460, §3 (new).]    
B. Directs that charges be signed and sworn in the name of another; or [1983, c. 460, §3 (new).]    
C. Has an interest, other than an official interest, in the prosecution of the accused. [1983, c. 460, §3 (new).] [1983, c. 460, §3 (new).]
      2. Active service. Active service is defined in section 101-A, subsection 1.[1987, c. 230, §2 (rpr).]
      3. Code. "Code" means this chapter.[1983, c. 460, §3 (new).]
      4. Commanding officer. "Commanding officer" means any officer vested with the authority for the direction, coordination and control of a military unit.[2001, c. 662, §41 (amd).]
      5. Enlisted person. "Enlisted person" means any person who is serving in an enlisted grade in any military force.[1983, c. 460, §3 (new).]
      6. Military forces. Military forces is defined in section 101-A, subsection 2.[1987, c. 230, §2 (rpr).]
      7. Military judge. "Military judge" means an official of a court-martial detailed in accordance with section 221.[1983, c. 460, §3 (new).]
      8. Military unit. "Military unit" means any military element whose structure is prescribed by a competent authority, such as a table of organization and equipment.[1983, c. 460, §3 (new).]
      9. Officer. "Officer" means a commissioned or warrant officer.[1983, c. 460, §3 (new).]
      10. Superior officer. "Superior officer" means an officer superior in rank or command.[1983, c. 460, §3 (new).]
