§769.  Transfer of boards, commissions, departments, and agencies to Department of Treasury

A.  The transfers and abolitions of agencies hereinafter made in this Section shall be effective on or before December 31, 1977, as provided in Chapter 24 of this Title.

B.  For purposes of this Chapter, references in Chapters 22 and 24 of this Title to the "secretary" shall refer to the state treasurer, references to the "undersecretary" shall refer to the deputy state treasurer for management and finance, and references to an "assistant secretary" shall refer to an assistant state treasurer.

C.  The following agencies, as defined by R.S. 36:3, are transferred to and hereafter shall be within the Department of the Treasury, as provided in R.S. 36:802:

(1)  State Bond Commission, including the powers, duties, functions, and responsibilities of any agencies which have been previously transferred to the State Bond Commission (Article VII, Section 8 of the Constitution of 1974; R.S. 39:451-39:456; R.S. 39:465.1-39:465.8; R.S. 39:466.11-39:466.13; 39:871; 39:1361-39:1366; 39:1401-39:1410; R.S. 47:1801-47:1808)

(2)  Interim Emergency Board (Const. Art. VII, §7; R.S. 39:461-461.8)

(3)  Repealed by Acts 1989, No. 662, §8, eff. July 7, 1989.

D.  The following agencies, as defined by R.S. 36:3, and the boards of each, except the Board of Supervisors of Louisiana State University and Agricultural and Mechanical College, are transferred to and shall be within the Department of the Treasury, as provided in R.S. 36:801.3:

(1)  Louisiana State Employees' Retirement System (R.S. 42:541-42:699)

(2)  State Police Retirement Fund (R.S. 40:1421-40:1444)

(3)  Louisiana State University Retirement System (R.S. 17:1611-17:1644)

(4)  Louisiana School Employees' Retirement System (R.S. 17:881-17:993)

(5)  Louisiana School Lunch Employees' Retirement System (R.S. 17:1231-17:1304)

(6)  Teachers' Retirement System of Louisiana (R.S. 17:571-17:764)

(7)  Repealed by Acts 1990, No. 217, §1.

(8) - (9)  Repealed by Acts 1991, No. 645, §2, eff. July 1, 1991.

E.  The following agencies, as defined by R.S. 36:3 are hereby abolished and their powers, duties, functions, and responsibilities are transferred to the state treasurer and hereafter shall be exercised and performed as provided in Part IV of Chapter 22 of this Title:

(1)  Repealed by Acts 1979, No. 233, §3.

(2)  Public Employees Board (R.S. 42:1001-42:1011)

F.  The following agencies, as defined by R.S. 36:3 are hereby abolished and their powers, duties, functions, and responsibilities are transferred and shall be exercised and performed within the Department of the Treasury to the extent and in the manner as otherwise provided by law:

(1)  Capital Construction and Improvement Commission (R.S. 39:465.1-39:465.8)

(2)  State Bond and Tax Board (R.S. 39:641-39:645; R.S. 39:871; R.S. 47:1801-47:1808)

(3)  State Bond and Building Commission (R.S. 39:451-39:456)

(4)  Repealed by Acts 1989, No. 662, §8, eff. July 7, 1989.

G.  Repealed by Acts 1998, 1st Ex. Sess., No. 150, §3, eff. July 1, 1998.

H.  The Medical Disability Board (R.S. 42:700.1) is placed within the Department of Treasury and shall exercise and perform its powers, duties, functions, and responsibilities in the manner provided for agencies transferred in accordance with the provisions of R.S. 36:802.

I.  The Louisiana Deferred Compensation Commission (R.S. 42:1301-42:1310) is placed within the Department of Treasury and shall exercise and perform its powers, duties, functions, and responsibilities in the manner provided for agencies transferred in accordance with the provisions of R.S. 36:801.1.

J.  The Louisiana Housing Finance Agency (R.S. 40:600.1-40:600.24) is transferred to the Department of the Treasury and shall exercise and perform its powers, duties, functions, and responsibilities in the manner provided for agencies transferred in accordance with R.S. 36:801.1.
