§239.3.  Miscellaneous provisions

A.  Nothing in this Part shall be construed to reduce or offset the liability for unpaid fees assessed to an impaired or insolvent insurer operating a plan with liability for fees assessed under this Part.

B.  For purposes of carrying out its obligations under this Part, the plan shall be deemed to be a creditor of an impaired or insolvent participating insurer to the extent of assets attributable to covered policies reduced by any amounts to which the plan is entitled for unpaid fees assessed.  As provided for under R.S. 22:1395.13, payment of contractual obligations of an impaired or insolvent insurer shall include fees assessed under this Part.

C.  Any unpaid fees assessed to a participating insurer shall become the liability of any continuing or successor insurer.
