§2199.  Applications; comments; local government

A.  The secretary shall furnish a copy of each permit or license application to the Department of Wildlife and Fisheries, the office of public works within the Department of Transportation and Development, the Department of Health and Hospitals, the Department of Justice, and the local governing authorities of any municipality and parish within whose territorial jurisdiction the facility or activity is or will be located.  The permittee shall file with the secretary two extra copies of each application, with one copy to be provided to the first intervenor and the other copy to be used by the office to allow for public access and inspection of the application.

B.  No facility shall be granted a permit or license if the location thereof violates a parish or municipal land use or zoning ordinance applicable to its siting in effect at the time of the original permit or license application.
