§1161.  Sale of livestock breeding services; contractual powers

A.  The secretary may authorize the warden or superintendent of any institution under his jurisdiction to contract with private entities for the sale of the breeding services of any of the livestock owned by and under the control of the department.  

B.  Each private entity which contracts with any of the various institutions shall indemnify and hold the secretary, the warden or superintendent, the state agency, the state, and any employees of the same harmless for any injury caused by the animal, unless the gross negligence or intentional act of any of the above was a substantial factor in causing the injury.  

C.  The secretary shall have the authority to adopt, in accordance with the Administrative Procedure Act, such rules and regulations as may be deemed necessary to provide for effective and efficient administration of this Section, including but not limited to specific contractual provisions.  

D.  The secretary may establish fees to be charged for all services provided at amounts which reflect the cost to the department of providing the services.
