304.38.1955 Construction of provisions for services by licensed optometrist or licensed ophthalmic dispenser to include same services from licensed physician.
Download pdfphysician. Any certificate, agreement, or contract issued in this state by a health maintenance
organization which provides coverage for services which can be lawfully performed
within the statutory scope of practice of a duly-licensed optometrist or duly-licensed
ophthalmic dispenser shall be deemed to provide benefits for such services whether
performed by a duly-licensed physician or a duly-licensed optometrist or duly-licensed
ophthalmic dispenser, notwithstanding any provision contained in the certificate,
agreement, or contract. Effective: July 15, 1996
