Subchapter 1 Generalities
224.1.070 Civil liability of persons polluting waters -- State may sue.
Download pdfdefined in KRS 224.01-010 or from any violation of the orders, rules, regulations, or
other determinations of the cabinet, the person responsible therefor shall be liable to the
Commonwealth in an amount reasonably necessary to restock or replenish such fish or
wildlife. The Commonwealth shall, in addition to the penalties provided for in KRS
224.99-010, be empowered to seek the recovery of such damages in any court of
competent jurisdiction in this Commonwealth in the event the person responsible fails or
refuses to pay for the restocking or replenishing of such fish or wildlife in the water or
area affected. Effective: June 17, 1978
