217.045 Unsafe food additives. Any poisonous or deleterious substance added to any food except where such substance is <br>required in the production thereof or cannot be avoided by good production or <br>manufacturing practice shall be deemed to be unsafe for purposes of the application of <br>KRS 217.025(1)(b), unless a tolerance for such substance has been prescribed under the <br>federal act or the Federal Environmental Pesticide Control Act of 1972 and the quantity <br>of such substance in or on the food is within the tolerance so prescribed or the substance <br>has been exempted from the requirement of a tolerance under the provisions of the federal <br>act or the Federal Environmental Pesticide Control Act of 1972.
