161.663 Disability retirement with less than required years of service. Any active contributing member with less than five (5) years of Kentucky service may <br>apply and be approved for disability retirement under KRS 161.661 if the member is <br>found to be mentally or physically incapacitated as a result of an injury related directly to <br>their covered employment. All conditions and restrictions specified under KRS 161.661 <br>shall be applicable, except that the initial annual disability allowance shall be equal to <br>fifty percent (50%) of the member's current annual contract salary and the member's last <br>annual contract salary shall be used in lieu of the final average salary in the recalculation <br>of the member's benefit at the expiration of the eligibility period.
