146.490 Custody of nature preserve.

146.490 Custody of nature preserve. An owner of an area which is dedicated as a nature preserve may retain custody thereof, <br>or may designate a custodian, subject to the rules and regulations of the commission. If <br>the owner or custodian declines, is unable, or fails to administer and manage the nature <br>preserve in accordance with the articles of dedication, the commission shall undertake <br>such custodial functions as may be necessary for the protection, maintenance, and use of <br>the nature preserve until the disability is removed. Whenever feasible, and consistent <br>with the articles of dedication, the commission shall vest custody of a nature preserve in <br>the former owner, a private organization or an individual.
