CHAPTER 96 UTILITIES IN CITIES
96.924 Final determination -- Second ordinance.
Download pdfhearing concerning the first ordinance shall be submitted. At such meeting, any sewer
users, or prospective sewer user, may again be heard, in person or by representative. The
governing body may adopt an ordinance to be known as the "Second Ordinance" which
may provide for rejection or adoption or partial adoption of the first ordinance proposals,
or total or partial adoption with modifications. If the governing body shall determine that
more than fifty percent (50%) of the sewer users or prospective sewer users, both in
number and in source of projected revenues, object to the proposals finally adopted by the
governing body, it may adopt the second ordinance only upon the affirmative vote of
three-fifths (3/5) of the membership of the governing body. The second ordinance shall be
published in the same manner as required with respect to first ordinance. Effective: June 19, 1958
