77.085 Election of chairman and vice chairman -- Secretary-treasurer and air pollution control officer -- Deputies, assistants, and other employees.

(1) In a county containing a city of the first or second class, the air pollution control board shall, in July of each year, elect from its members a chairman and a vice <br>chairman who shall be of different political party affiliation. The board shall employ <br>a competent secretary-treasurer and an air pollution control officer, neither of whom <br>shall be a member of the board. The secretary-treasurer and the air pollution control <br>officer shall devote their entire time and attention exclusively to the services of the <br>board. (2) The air pollution control officer shall be an engineer by profession and shall be a graduate of a recognized university or college, shall be thoroughly familiar with the <br>theory and practice of the prevention and control of air pollution, and shall meet the <br>qualifications for a nonelective peace officer stated in KRS 61.300. (3) The secretary-treasurer and the air pollution control officer may be removed by the board, for cause, after hearing by it and after at least ten (10) days notice in writing <br>shall have been given to the secretary-treasurer or the air pollution control officer, <br>as the case may be, which notice shall embrace the charges preferred against the <br>person. At the hearing the person may be represented by counsel. The finding of the <br>board shall be final. (4) The board may provide for assistants, deputies, clerks, attaches, and other persons to be employed by the secretary-treasurer and the air pollution control officer, and <br>the times at which they shall be appointed.
