362.1-110 Effective time and date of document. (1) Except as provided in subsection (2) of this section, a statement shall be effective at the date and time of filing, as evidenced by such means as the Secretary of State may use for the purpose of recording the date and time of filing. (2) A statement may specify a delayed effective time and date, and if it does so and is filed pursuant to subsection (1) of this section, the statement shall become effective at the time and date specified. If a delayed effective date but no time is specified, the statement shall be effective at the close of business on that date. A delayed effective date for a statement shall not be later than the ninetieth day after the date it is filed. (3) Except as provided in KRS 362.1-303(5), a statement filed in accordance with this subchapter shall be effective regardless of a failure to file the statement with the county clerk.
