262.390 Votes necessary for approval -- Effect of regulation. (1) The board shall not enact a proposed land-use regulation into law unless at least ninety percent (90%) of the votes cast in the referendum have been cast for approval of the proposed regulation, and unless landowners voting to enact the proposed regulation own at least eighty percent (80%) of the land within the district. (2) The approval of the regulation by ninety percent (90%) of the votes cast in the referendum shall not require the board to enact the proposed regulation into law. (3) Land-use regulations, proposed after the board has determined that uncontrolled soil erosion on some lands within the district is causing damage to other lands within the district, and prescribed in regulations adopted by the board shall have the force and effect of law in the district. (4) Land-use regulations apply to publicly owned lands, and shall be observed by agencies administering such lands. Effective: October 1, 1942 History: Recodified 1942 Ky.
