CHAPTER 523I - IOWA CEMETERY ACT
523I.313 - NEW CEMETERIES AND GARDENS AND CEMETERY REGISTRY.

        523I.313  NEW CEMETERIES AND GARDENS AND CEMETERY
      REGISTRY.
         1.  A person that dedicates property for a new cemetery on or
      after July 1, 2005, and a cemetery that dedicates an additional
      garden on or after July 1, 2005, shall:
         a.  In the case of land, survey and subdivide the property
      into gardens with descriptive names or numbers and make a map or plat
      of the cemetery or garden.
         b.  In the case of a mausoleum or a columbarium, make a map or
      plat of the property delineating sections or other divisions with
      descriptive names and numbers.
         c.  File the map or plat with the commissioner, including a
      written certificate or declaration of dedication of the property
      delineated by the map or plat, dedicating the property for cemetery
      purposes.
         2.  A map or plat and a certificate or declaration of dedication
      that is filed pursuant to this section dedicates the property for
      cemetery purposes and constitutes constructive notice of that
      dedication.
         3.  The commissioner shall maintain a registry of perpetual care
      and nonperpetual care cemeteries, to the extent that information is
      available.  A cemetery selling interment rights on or after July 1,
      2005, shall file a written notice with the commissioner that includes
      the legal description of the property with boundary lines of the
      land, the name of the cemetery, the status of the cemetery as either
      perpetual care or nonperpetual care, the status of the cemetery as
      either religious or nonreligious, and the cemetery's ownership in a
      form approved by the commissioner.  A cemetery shall notify the
      commissioner of any changes in this information within sixty days of
      the change.
