Chapter 13. Certain Property Transactions by the
Department of Natural Resources With the United States
IC 4-20.5-13-1
Applicable statutes
Sec. 1. The following statutes apply to a property transaction
under this chapter:
(1) IC 4-20.5-7-3.
(2) IC 4-20.5-7-4.
(3) IC 4-20.5-7-5.
(4) IC 4-20.5-7-6.
(5) IC 4-20.5-7-17.
(6) IC 4-20.5-7-18.

Lighthouse, beacon, or other aid to navigation site; federal
acquisition of state property; magnitude; jurisdiction
Sec. 2. (a) This section applies only to state property covered by
navigable waters of the United States.
(b) If an authorized agent of the United States requests the
conveyance of state property for the site of a lighthouse, beacon, or
other aid to navigation, the state may convey the property to the
United States.
(c) The property conveyed under this section may not exceed ten
(10) acres for a particular transaction requested by the United States.
(d) Subject to subsection (e), the governor may cede the
jurisdiction of the state to the United States over property conveyed
under this section.
(e) If the governor cedes jurisdiction under subsection (d), the
state shall retain concurrent jurisdiction with the United States so
that civil or criminal process issued under the state can be executed:
(1) by the proper officers of the state;
(2) upon a person subject to that process;
(3) within the limits of the property ceded; and
(4) in the same manner and to the same effect as if jurisdiction
had not been ceded to the United States.
