Chapter 17. Food: Regulation of Sodium Saccharin, N.F.

Permitted activities
Sec. 1. Notwithstanding any rule or regulation adopted by the
federal Food and Drug Administration concerning sodium saccharin,
N.F., the chemical substance sodium saccharin, N.F. may be
manufactured, distributed, sold, and used within Indiana.

Powers of board of pharmacy and department of health
Sec. 2. (a) The Indiana board of pharmacy and the state
department may not prohibit the manufacture, distribution, sale, or
use of sodium saccharin, N.F. within Indiana, either as a component
of any other substance produced within Indiana or as a separate
product.
(b) The state department may regulate the manufacture,
distribution, sale, or use of sodium saccharin, N.F. only to ensure that
the substance is not adulterated or misbranded within the meaning of
IC 16-42-2 and IC 16-42-3.

Manufacture, distribution, sale, or use not prohibited
Sec. 3. A person who is engaged in the manufacture, sale,
distribution, or use of sodium saccharin, N.F. may not be prohibited
from the manufacture, sale, distribution, or use of sodium saccharin,
N.F. within Indiana.
