2005 Illinois Code - Chapter 615 Waterways 615 ILCS 110/ Kankakee River Dam Transfer Act.
(615 ILCS 110/1) Sec. 1. Short title. This Act may be cited as the Kankakee River Dam Transfer Act. (Source: P.A. 87‑1219.)
(615 ILCS 110/5) Sec. 5. Authorization to acquire. The Department of Transportation, on
behalf of the State of Illinois, is authorized to acquire by donation from
the City of Wilmington in Will County, Illinois and other owners the
existing Kankakee River dam and its abutments, millrace, millrace structures,
and all other improvements constructed in connection with the dam; the sites on
which the dam, abutments, millrace, millrace structures, and other improvements
are constructed; and all water, flowage easements, and other privileges at law
or in equity that the present owners or their predecessors acquired in and to

(615 ILCS 110/10) Sec. 10. Powers of Department of Transportation. After the real estate
and structures described in Section 5 have been acquired, the Department of
Transportation may reconstruct, repair, restore, rehabilitate, demolish,
lease for a period not to exceed 20 years, sell, transfer or convey,
exchange, develop or otherwise utilize these lands with their appurtenances
acquired under this Act in the best interest of the State of Illinois. (Source: P.A. 87‑1219.)
