DISSOLUTION OF HIGHWAY DISTRICTS

40-1810. Expenses of dissolution -- How borne and paid. [effective until january 1, 2011] All expenses of proceedings to dissolve highway districts, including the posting and publication of notices of hearings on the petitions and of the election, the printing of ballots and compensation of judges and clerks of election, shall be borne by the highway district. In cases where the proposal to dissolve shall be defeated, either by order of the commissioners upon hearing the petitions, or at the election, the expense shall be paid by the appropriate district treasurer out of any current funds on hand on an order presented by the clerk of the commissioners; and, when the proposal to dissolve shall have been adopted at an election, the expense of all proceedings shall be paid by the county treasurer out of the first moneys received from or on account of the respective district.
