53-6-70. (Pre-1998 Probate Code) Renunciation of right as executor


If the executor fails to offer the will for probate for an unreasonable time or does not qualify within the time specified, he shall be deemed to have renounced his right as executor. If, however, there are several executors and one executor qualifies in the time specified and afterward dies or is removed, another executor may then qualify within 12 months from the death of his coexecutor and shall be entitled to all the rights of an originally qualified executor.
