2005 Arizona Revised Statutes - Revised Statutes §36-595.03  Secure facilities; annual review; definition

A. The division of developmental disabilities in the department shall annually evaluate the need for a secure facility. The evaluation shall identify those persons who are incompetent to stand trial and a threat to public safety and who are not in an otherwise safe and secure setting. If the division identifies at least twenty-five persons who meet this criteria, the department shall request funding for a secure facility. The division shall not include a person who is also diagnosed with a mental health illness in this calculation.

B. For the purposes of this section, "incompetent to stand trial" and "threat to public safety" have the same meaning prescribed in section 13-4501.
