TITLE 25 MARITAL AND DOMESTIC RELATIONS
Chapter 25.25. UNIFORM RECIPROCAL ENFORCEMENT OF SUPPORT ACT
Sec. 25.25.175. PATERNITY.

If the obligor asserts as a defense that the obligor is not the father of the child for whom support is sought and the court finds that the defense is not frivolous, then if both of the parties are present at the hearing, or the court finds that the presence of either or both of the parties is not necessary, the court may adjudicate the paternity issue. Otherwise, the court may continue the action until the paternity issue has been adjudicated. Nothing in this section is intended to diminish the standard of proof for establishing paternity.
