Fourth Court of Appeals San Antonio, Texas MEMORANDUM OPINION No. 04-17-00384-CV IN RE ADAN VOLPE PROPERTIES, LTD, and Maricela Volpe, General Partner Original Mandamus Proceeding 1 PER CURIAM Sitting: Karen Angelini, Justice Luz Elena D. Chapa, Justice Irene Rios, Justice Delivered and Filed: September 20, 2017 PETITION FOR WRIT OF MANDAMUS DENIED On June 15, 2017, relators Adan Volpe Properties, Ltd., and Maricela Volpe, General Partner, filed a petition for writ of mandamus, complaining of the trial court’s order compelling arbitration and its refusal to rule on their motion for summary judgment. Relators also filed a motion for emergency stay, which was granted on June 16, 2017. The court has considered relators’ petition for writ of mandamus and is of the opinion that relators have not demonstrated they are entitled to the relief sought. Accordingly, we deny the petition for writ of mandamus and lift the June 16, 2017 stay. PER CURIAM 1 This proceeding arises out of Cause No. 2013CVF000127D3, styled Donato Volpe, Jr. v. Adan Volpe Properties, Ltd., and Maricela Volpe, General Partner, pending in the 341st Judicial District Court, Webb County, Texas, the Honorable Becky Palomo presiding.
