DISMISSED FOR WANT OF PROSECUTION

This is an appeal from a judgment terminating appellant's parental rights. The trial court found the points on which appellant states she intends to appeal to be frivolous and further found that the appellant is not indigent. See Tex. Fam. Code Ann. 263.405(c),(d)(3) (Vernon Supp. 2007). On October 24, 2007, we ordered that appellant file a brief on the issue of whether the appeal is frivolous and/or whether she is indigent no later than November 13, 2007. See id. 263.405(d). Neither the brief nor a motion for extension of time was filed in response to our order.

On November 19, 2007, we ordered appellant to file her brief on the issue of whether the appeal is frivolous and/or whether she is indigent no later than December 4, 2007. Our order stated that if appellant failed to file a brief by the date ordered, we would dismiss the appeal for want of prosecution. See Tex. R. App. P. 38.8(a); see also In re C.D.H., No. 04-05-00273-CV, 2005 WL 2755936, at *1 (Tex. App.--San Antonio Oct. 26, 2005, no pet.) (dismissing appeal for want of prosecution when appellant failed to file brief on issues of indigence and whether appeal was frivolous). Appellant failed to file a brief in response to our order; therefore, this appeal is dismissed for want of prosecution. See In re C.D.H., 2005 WL 2755936, at *1.
