PETITION FOR WRIT OF MANDAMUS DENIED

Relator Jerry Lee Edwards has filed a pro se petition for a writ of mandamus asking this court to compel the trial judge in his criminal case to: (1) rule on pre-trial motions; and (2) go to trial or reduce his bond. Edwards is represented by trial counsel below.

It is well-established that a criminal defendant does not have a right to hybrid representation, that is, to proceed pro se and be represented by counsel at the same time. Scheanette v. State, 144 S.W.3d 503, 505 n. 2 (Tex. Crim. App. 2004) (citing Patrick v. State, 906 S.W.2d 481, 498 (Tex. Crim. App. 1995)); Gray v. Shipley, 877 S.W.2d 806, 806 (Tex. App.--Houston [1st Dist.] 1994, orig. proceeding). We conclude that Edwards's trial counsel is also his counsel for any mandamus proceeding on the issues presented. Thus, Edwards's pro se mandamus petition presents nothing for review. The petition is denied.
