REVERSED AND REMANDED

The parties to this appeal have filed an agreed motion, stating that they have compromised and settled all issues in dispute between them. They request that the trial court's judgment be reversed, and that the cause be remanded for the entry of a judgment in conformity with their settlement agreement. A second defendant in the underlying lawsuit, Kent Rohweder, M.D., filed a response to the motion asserting that the disposition of this appeal should not disturb the take nothing judgment rendered in his favor.

The motion is granted. The portion of the trial court's judgment pertaining to the claims asserted between the parties to this appeal is reversed, and the cause is remanded for the entry of a judgment in conformity with the parties' settlement agreement. The portion of the trial court's judgment pertaining to the claims by appellee against Kent Rohweder, M.D. is not affected by this court's disposition of this appeal. Costs of appeal are taxed against the parties who have incurred them.
