Annotate this Case
MEMORANDUM OPINION
No. 04-04-00383-CV
IN THE INTEREST OF A.M.M., a Child
From the 166th Judicial District Court, Bexar County, Texas
Trial Court No. 2003EM503088
Honorable Carol Haberman Knight-Sheen, Judge Presiding

PER CURIAM

Sitting: Alma L. L pez, Chief Justice

Catherine Stone, Justice

Paul W. Green, Justice

Delivered and Filed: July 28, 2004

DISMISSED AS MOOT

On April 5, 2004, appellant filed a notice of appeal seeking to appeal an order establishing the parent-child relationship that was entered on March 31, 2004. On April 27, 2004, appellant filed a motion for new trial and motion to dismiss, contending that the parties previously had entered into an agreed order regarding child support and medical insurance and that the agreed order estopped the appellees from requesting a new order. On May 5, 2004, the trial court granted a new trial on the issues of child support and arrearage.

On June 16, 2004, we issued an order directing the appellant to show cause in writing why the appeal should not be dismissed as moot in light of the trial court's order granting a new trial. Appellant did not respond to our order. Because appellant's motion for new trial was granted, this appeal is moot. Accordingly, the appeal is dismissed as moot.
