MEMORANDUM OPINION

No. 04-03-00670-CR

No. 04-03-00671-CR

EX PARTE ALFRED MCVEA

From the 227th Judicial District Court, Bexar County, Texas

Trial Court Nos. 2002-CR-1660 & 2002-CR-3429

Honorable Philip Kazen, Judge Presiding

PER CURIAM

Sitting: Alma L. L pez, Chief Justice

Sandee Bryan Marion, Justice

Phylis J. Speedlin, Justice

Delivered and Filed: November 26, 2003

DISMISSED AS MOOT

On September 3, 2003, appellant filed notices of appeal from orders denying habeas corpus relief with respect to bail pending appeal. On October 1, 2003, this court dismissed appellant's appeals from his plea of nolo contendere in trial cause numbers 2002-CR-1660 and 2002-CR-3429. See McVea v. State, No. 04-03-00465-CR, No. 04-03-00466-CR, 2003 WL 22242012 (Tex. App.--San Antonio Oct. 1, 2003, n.p.h.) (not designated for publication). Because appellant's underlying appeals have been dismissed, it appears appellant's appeal of the denial of his request for bail is now moot. Accordingly, we ordered appellant to show cause why this appeal should not be dismissed. No response has been received.

These appeals are therefore dismissed as moot.
