PETITION FOR WRIT OF MANDAMUS DISMISSED IN PART AS MOOT AND DENIED IN PART

Arturo Solis filed a petition for writ of mandamus, seeking an order directing the trial court to declare the judgments in three misdemeanor cases void because the judgments were allegedly rendered without there being an information on file. Solis alleged he filed an application for writ of habeas corpus in each of the misdemeanor cases, but that the trial court had failed to consider and rule on them. Each application sought relief on the identical grounds asserted here.

The State of Texas, the real party in interest, has filed a response, attaching a certified copy of the trial court's order signed May 5, 2003, denying relief in the habeas proceedings.

We therefore dismiss as moot Solis' request for an order compelling the trial court to consider and rule on his applications for writs of habeas corpus. We deny Solis' petition for an order compelling the trial court to declare the misdemeanor judgments void because Solis has an adequate remedy by appeal from the orders in the habeas proceedings.

No costs shall be assessed against relator because he is indigent.

The clerk of this court is directed to transmit a copy of this opinion to the attorneys of record, the trial court judge, and the trial court clerk.
