In the Interest of D.P., A Child--Appeal from 150th Judicial District Court of Bexar County

Annotate this Case
MEMORANDUM OPINION
No. 04-03-00194-CV
IN THE INTEREST OF D.P., a child
From the 150th Judicial District Court, Bexar County, Texas
Trial Court No. 2002-PA-01421
Honorable Michael Peden, Judge Presiding

PER CURIAM

Sitting: Catherine Stone, Justice

Paul W. Green, Justice

Sarah B. Duncan, Justice

Delivered and Filed: April 23, 2003

DISMISSED FOR WANT OF JURISDICTION

Because this is an accelerated appeal, the notice of appeal was due to be filed on February 25, 2003. See Tex. Fam. Code Ann. 263.405 (Vernon 2002); Tex. R. App. P. 26.1(b). A motion for extension of time to file the notice of appeal was due on March 12, 2003. See Tex. R. App. P. 26.3. Appellant filed his notice of appeal on March 11, 2003. Although appellant filed a notice of appeal within the fifteen-day grace period allowed by Rule 26.3, he did not file a motion for extension of time. Accordingly, on March 24, 2003, this court ordered appellant to file, by April 3, 2003, a response presenting a reasonable explanation for failing to file the notice of appeal in a timely manner. No response has been filed. Therefore, this appeal is dismissed for lack of jurisdiction. See Tex. R. App. P. 42.3.
