MEMORANDUM OPINION
Before Justices O'Neill, Richter, and Lang-Miers
By letter dated April 30, 2010, the Court notified appellant that the $175 filing fee for the appeal was due. We directed appellant to pay the fee within ten days, and warned that failure to comply would result in dismissal of the appeal. See Tex. R. App. P. 42.3(c). To date, appellant has not paid the filing fee, and the Court has received a copy of the trial court's May 25, 2010 notice stating appellant's affidavit of indigence was denied. Accordingly, we dismiss the appeal.
