MEMORANDUM OPINION
Before Justices FitzGerald, Murphy, and Fillmore
        By order dated October 12, 2010, the Court ordered the Dallas County District Clerk to file, within fifteen days, either the clerk's record or written verification that appellant had not paid for the record. We warned appellant that verification of non-payment would result in dismissal of the appeal without further notice.  See Tex. R. App. P. 37.3(b). On October 20, 2010, we received a letter from the Dallas County District Clerk stating appellant has not paid for the clerk's record. Accordingly, we dismiss the appeal.
