MEMORANDUM OPINION

By letter dated September 16, 2010, the Court notified appellant that his brief is overdue. We directed appellant to file, within ten days, both his brief and an extension motion, and warned that failure to comply would result in dismissal of the appeal. See Tex. R. App. P. 38.8(a). To date, appellant has neither filed a brief nor otherwise communicate with the Court regarding the appeal. Accordingly, we dismiss the appeal.
