Opinion By Justice Richter
        On September 8, 2010, appellant, Gifford B. Jackson, filed a motion to dismiss the appeal. Jackson states in his motion that he and appellees, Christopher B. Horton and Alan D. Wright, have agreed to settle. We grant Jackson's motion to dismiss the appeal.
        Accordingly, we dismiss this appeal. See Tex. R. App. P. 42.1(a)(1).
