MEMORANDUM OPINION
Before Justices Morris, Moseley, and Myers
 
        On August 7, 2003, we abated this appeal pending the disposition of an appeal in the Eighth District Court of Appeals on remand from the United States Supreme Court. Pursuant to the abatement order, appellant was to file a motion to reinstate this appeal or any other appropriate motion within thirty days after the Eighth District Court of Appeals issued its judgment. That court issued its opinion and judgment in 2004 and its mandate in 2007. See Cass v. Stephens, 156 S.W.3d 38 (Tex. App.- El Paso 2004, pet. denied). Therefore, by letter dated June 7, 2010, we directed appellant to file, within fifteen days, either a motion to dismiss the appeal or a motion to reinstate indicating why the appeal should proceed. We warned that failure to comply would result in dismissal of the appeal. See Tex. R. App. P. 42.3. To date, appellant has not filed any motions or otherwise communicated with the Court regarding the appeal.
        Accordingly, we dismiss the appeal.
