The opinion and Order filed on April 6, 2010, in this matter are withdrawn. This matter is remanded to the Court of Common Pleas of Northampton County so that in accordance with the parties agreement, that court may vacate the order filed September 10, 2009, and grant Mr. Flaherty s appeal of the notice of suspension.
