DECISION
This matter is before the court on its own motion to dismiss the complaint for lack of
jurisdiction. A case management conference was convened on April 16, 2001. Rhonda
Swearingen participated on her own behalf; Joe Honl represented the defendant.
Plaintiff is concerned that her mortgage company increased the monthly deduction
for her property’s tax escrow account. This was (apparently) in reaction to a one-time
charge as a result of certain mandatory clerical error corrections made in May of 2000.
Plaintiff’s issue is better directed to the mortgage company; the defendant’s
representative has assisted in those efforts and pledged further cooperation. Plaintiff
does not timely raise any concerns as to the current year’s real market or assessed values
as determined by defendant.
After considering the record, the court finds the motion should be granted. The
complaint does not allege facts which bring the claims within the specialized jurisdiction of
this court. See ORS 305.410. Now, therefore,
IT IS THE DECISION OF THE COURT that the appeal is hereby dismissed.
