DECISION OF STIPULATION
This matter is before the court upon the agreement of the parties. On
December 14, 2000, plaintiff filed an appeal with this court claiming defendant erred when
it disqualified the property identified as Account No. 8627 from farm use special
assessment for the 2000-01 tax year. After reviewing the case, defendant agrees the
property should be reinstated in the farm deferral program. Because the parties are in
agreement, the case is ready for decision. Now, therefore;
IT IS THE DECISION OF THIS COURT that the county shall reinstate the subject
property in the farm deferral program for the 2000-01 tax year; and
IT IS FURTHER DECIDED that the county shall correct the assessment and tax rolls
to reflect the above decision. Any refund due following this correction shall be promptly
paid with statutory interest.
