Appeal from a decision of the Civil Court of the City of New York, Kings County (Arlene Bluth, J.), dated January 3, 2006, deemed from a judgment of the same court entered July 11, 2006 (see CPLR 5520 [c]). The judgment, after a nonjury trial, dismissed the complaint.

Judgment affirmed without costs.

For the reasons stated in V.S. Med. Servs., P.C. a/a/o Carlos Gaviria v Allstate Insurance Co. (___ Misc 3d ___, 2009 NY Slip Op _____ [Appeal No. 2008-571 K C, decided herewith]), the judgment is affirmed.
