CHAKA KWANZAA,

Appellant,

v.

DEPARTMENT OF CORRECTIONS,

Respondent.

_________________________________

Submitted: March 28, 2006 - Decided April 10, 2006

Before Judges Kestin and Lefelt.

On appeal from the Department of Corrections.

Chaka Kwanzaa, appellant pro se.

Zulima V. Farber, Attorney General, attorney for respondent (Jean Reilly, Deputy Attorney General, of counsel; Kimberly A. Sked, Deputy Attorney General, on the brief).

PER CURIAM

Chaka Kwanzaa, an inmate at South Woods State Prison, appeals from a disciplinary determination for engaging in a prohibited act: refusing to work or to accept a program or housing unit assignment. See N.J.A.C. 10A:4-4.1(a).254. Following a hearing, the hearing officer sustained the charge. On internal appeal the recommended sanction was "modified to read as follows: Suspend 60 days LOCT [loss of commutation time] for 60 days." An additional initial charge of violating N.J.A.C. 10A:4-4.1(a)*.306, "conduct which disrupts or interferes with the security or orderly running of the correctional facility[,]" was reduced to an "on the spot" correction and did not affect the sanction imposed.

We have reviewed the record in the light of the arguments advanced by the parties and prevailing standards of law. None of appellant's arguments have sufficient merit to warrant discussion in a written opinion. R. 2:11-3(e)(1)(D), (E). There was no denial of due process of law. See McDonald v. Pinchak, 139 N.J. 188 (1995); Jacobs v. Stephens, 139 N.J. 212 (1995); Avant v. Clifford, 67 N.J. 496 (1975).

Affirmed.
