LESLIE GENSER,

Plaintiff-Respondent,

vs.

MYRA GENSER,

Defendant-Appellant.

Submitted: June 20, 2006 - Decided July 14, 2006

Before Judges Conley and Cuff.

On appeal from the Superior Court of New Jersey, Chancery Division - Family Part, Bergen County, Docket No. FM-02-1310-02.

Thomas W. Williams, attorney for appellant.

Gina A. Calogero, attorney for respondent.

PER CURIAM

Defendant Myra Genser appeals from two orders entered on October 21, 2005. One enforced the terms of the March 4, 2004 Judgment of Divorce that directed the weekly alimony due from plaintiff Leslie Genser to defendant be reduced from $619 to $496 commencing March 2, 2005. The second order denied defendant's motion that sought to declare a daughter unemancipated and sought to continue alimony at $619 weekly.

Judge Koblitz found that defendant submitted the same evidence in opposition to plaintiff's motion and in support of her motion as she submitted at trial. Thus, the judge held that defendant had not established changed circumstances. She also found that the parties' daughter was the beneficiary of a trust, thereby negating the need for support from plaintiff.

On appeal, defendant raises two points. First, she contends that the judge failed to consider her disability. She also argues that her daughter should have been declared unemancipated.

Having examined the record in light of the contentions of the parties, we conclude that the arguments presented by defendant are without sufficient merit to warrant discussion in a written opinion. R. 2:11-3(e)(1)(E).

Affirmed.
