STATE OF MICHIGAN COURT OF APPEALS PEOPLE OF THE STATE OF MICHIGAN, UNPUBLISHED September 27, 2002 Plaintiff-Appellee, v No. 226743 Wayne Circuit Court LC No. 99-006103 ANTHONY O. WRIGHT, Defendant-Appellant. AFTER REMAND Before: Holbrook, Jr., P.J., and Gage and Meter, JJ. MEMORANDUM. This case returns to this Court following remand to the trial court. Defendant appealed as of right his convictions of second-degree murder, MCL 750.317, assault with intent to commit murder, MCL 750.83, and possession of a firearm during the commission of a felony, MCL 750.227b. We affirmed the convictions but remanded for further articulation of the trial court’s reasons for exceeding the sentencing guidelines. On review of the trial court’s detailed explanation of its reasons for upward departure, we conclude the court stated substantial and compelling reasons for the departure. See People v Babcock, 244 Mich App 64, 74-75; 624 NW2d 479 (2000). The court properly determined that the sentencing guidelines do not adequately reflect the circumstances of defendant’s life, which involved dealing drugs, and do not adequately reflect the nature of defendant’s actions in committing the crimes. Defendant acted in a predatory manner. Motivated by drugs, he armed himself with a shotgun and sought out one of the victims. Affirmed. /s/ Donald E. Holbrook, Jr. /s/ Hilda R. Gage /s/ Patrick M.
