STATE OF MICHIGAN COURT OF APPEALS In the Matter of HRM, Minor. FAMILY INDEPENDENCE AGENCY, UNPUBLISHED January 29, 2002 Petitioner-Appellee, v No. 232261 Macomb Circuit Court Family Division LC No. 00-045873-NA ROBERT MOUTARD, Respondent-Appellant, and RENEE MOUTARD, Respondent. In the Matter of HRM, Minor. FAMILY INDEPENDENCE AGENCY, UNPUBLISHED Petitioner-Appellee, v No. 232323 Macomb Circuit Court Family Division LC No. 00-045873-NA RENEE MOUTARD Respondent-Appellant, and ROBERT MOUTARD, Respondent. -1- Before: Sawyer, P.J., and O’Connell and Zahra, JJ. MEMORANDUM. In these consolidated appeals, respondents appeal as of right from the trial court's order terminating their parental rights to the minor child under MCL 712A.19b(3)(c)(i) and (g). We affirm. This Court reviews for clear error both the trial court's decision regarding whether a statutory ground for termination was proven by clear and convincing evidence and its decision regarding a child's best interest. MCR 5.974(I); In re Trejo Minors, 462 Mich 341, 356-357; 612 NW2d 407 (2000). We conclude that the trial court did not clearly err in finding that the statutory ground for termination under §19b(3)(c)(i) was established by clear and convincing evidence. Because the trial court properly terminated respondents' parental rights under §19b(3)(c)(i), and only one statutory ground for termination must be established in order to terminate parental rights, we need not decide whether termination was also proper under §19b(3)(g). See In re Trejo, supra, at 360. Further, considered in its entirety, the evidence did not show that termination of respondents' parental rights was clearly not in the child's best interest. Thus, the trial court did not err in terminating respondents' parental rights to the child. Id. at 364. Affirmed. /s/ David H. Sawyer /s/ Peter D. O’Connell /s/ Brian K. Zahra -2-
