STATE OF MICHIGAN COURT OF APPEALS ABRAHAM NUNU, UNPUBLISHED November 6, 2001 Plaintiff-Appellee, V CITY OF DETROIT and DETROIT BUILDING SAFETY & ENGINEERING DEPARTMENT, No. 220590 Wayne Circuit Court LC No. 99-900948 AW Defendant-Appellants. Before: Bandstra, C.J., and White and Collins, JJ. WHITE, J. (concurring). I concur in the reversal. Plaintiff was required to obtain a special use permit notwithstanding that the property had at an earlier time been operated as a gas station, which use had been discontinued before plaintiff purchased the property. And, as the majority observes, defendant’s actions did not create an estoppel against its enforcement of the special use permit requirement. /s/ Helene N. White -1-
