STATE OF MICHIGAN COURT OF APPEALS In the Matter of FATIMA ANNE FLEMING, TERRI ANDRIEA FLEMING, ANGEL GARDENIA WEST, and TERRENCE MICHAEL WEST, Minors. FAMILY INDEPENDENCE AGENCY UNPUBLISHED March 3, 1998 Petitioner-Appellee, v No. 203154 Wayne Juvenile Court LC No. 94-321893 FATIMA ESTHER FLEMING, a/k/a FATIMA ESTHER WEST, Respondent-Appellant, and TERRENCE WEST, Respondent. FAMILY INDEPENDENCE AGENCY Petitioner-Appellee, v No. 203252 Wayne Juvenile Court LC No. 94-321893 TERRENCE M. WEST, Respondent-Appellant, and FATIMA ESTHER FLEMING, Respondent. . -1 -2 Before: Michael J. Kelly, P.J., and Fitzgerald and M.G. Harrison*, JJ. PER CURIAM. Respondents filed separate appeals as of right from a juvenile court order terminating their parental rights to the minor children under MCL 712A.19b(3)(c)(i), (g) and (j); MSA 27.3178(598.19b)(3)(c)(i), (g) and (j). We affirm. These consolidated appeals have been decided without oral argument pursuant to MCR 7.214(E). We note that respondents have not sought judicial review of the referee’s findings and recommendations pursuant to MCR 5.991. In any event, neither respondent has demonstrated that the referee clearly erred in recommending that their parental rights be terminated under the clearly erroneous standard in In re Hall-Smith, 222 Mich App 470; 564 NW2d 156 (1997). Further, limiting our review to the record, respondent Terrence West has not established any basis for relief due to ineffective assistance of counsel. People v Pickens, 446 Mich 298; 521 NW2d 797 (1994); People v Dixon, 217 Mich App 400, 408; 552 NW2d 663 (1996); In re Schmeltzer, 175 Mich App 666, 673; 438 NW2d 866 (1989); In re Simon, 171 Mich App 443, 447; 431 NW2d 71 (1988). Hence, we uphold the juvenile court’s order terminating the respondents’ parental rights based on the referee’s findings and recommendations. However, petitioner’s request for relief under MCR 7.215(E)(2) is denied. Affirmed. /s/ Michael J. Kelly /s/ E. Thomas Fitzgerald /s/ Michael G. Harrison * Circuit judge, sitting on the Court of Appeals by assignment. . -3
