COURT OF APPEALS
PEOPLE OF THE STATE OF MICHIGAN,
UNPUBLISHED
February 13, 1998
Plaintiff-Appellee,
v
No. 194109
Recorder’s Court
LC No. 92-014013
ANITA MATTISON,
Defendant-Appellant.
Before: Markey, P.J., and Doctoroff and Smolenski, JJ.
MEMORANDUM.
Following a bench trial, defendant was convicted of larceny from a building, MCL 750.360;
MSA 28.592, and sentenced to two to four years’ imprisonment. We dismiss defendant’s appeal
because her only issue, a challenge to the proportionality of her sentence, has been rendered moot by
the expiration of the minimum term. People v Rutherford, 208 Mich App 198, 204; 526 NW2d 620
(1994).
Dismissed.
/s/ Jane E. Markey
/s/ Martin M. Doctoroff
/s/ Michael R. Smolenski
