WHITE, J. (concurring)
I concur on the basis that Drs. Forrester and Engleberg did not provide causation testimony,
and Dr. Dickinson’s testimony was insufficient regarding the time period when intravenous antibiotic
treatment would likely have been effective, as that time period relates to the date malpractice was
established. Plaintiff’s standard of care expert identified June 23, 1994 as the date malpractice was
established. Dr. Dickinson’s testimony did not establish that Sandoval’s conduct on or after June 23
(the date on which Sandoval received the test results indicating that plaintiff had an elevated
sedimentation rate) was a proximate cause of the injury (the need for surgery).
