STATE OF MICHIGAN
COURT OF APPEALS
PEOPLE OF THE STATE OF MICHIGAN,
UNPUBLISHED
May 30, 1997
Plaintiff-Appellee,
v
No. 186858
Genesee Circuit Court
LC No. 94-051233 FH
DERRICK MCKINLEY TILLMAN,
Defendant-Appellant.
Before: Saad, P.J., and Hood and McDonald, JJ.
MEMORANDUM.
Defendant pleaded guilty to felonious assault, MCL 750.82; MSA 28.277, and received an
enhanced sentence of 32 to 180 months’ imprisonment, reflecting his status as a fourth offender.
Defendant appeals as of right. We affirm.
Defendant’s sentence does not violate the principle of proportionality, especially in light of the
benefit bestowed upon defendant by the plea bargain, and defendant’s history of assaultive behavior.
People v Terry, 217 Mich App 660, 664; 553 NW2d 23 (1996); People v Ward, 206 Mich App 38,
45; 520 NW2d 363 (1994).
Affirmed.
