RENDERED: March 5, 2004; 10:00 a.m. NOT TO BE PUBLISHED Commonwealth Of Kentucky Court of Appeals NO. 2002-CA-002520-MR KAREN VAN HOLTEN APPELLANT APPEAL FROM GRANT CIRCUIT COURT HONORABLE STEPHEN L. BATES, JUDGE ACTION NO. 00-CI-00126 v. MARK G. VAN HOLTEN APPELLEE OPINION AND ORDER DISMISSING ** ** ** ** ** BEFORE: DYCHE, GUIDUGLI, AND MCANULTY, JUDGES. DYCHE, JUDGE. On May 13, 2003, this Court entered an order for Karen Van Holten to show cause why her appeal should not be dismissed as untimely taken. The sentencing order was entered on June 12, 2002, and a subsequent order detailing the terms of incarceration was entered on July 5, 2002. Appellant’s two subsequent motions did not toll the thirty day filing requirement. Notice of appeal should have been filed no later than within thirty days of July 5, 2002. Karen Van Holten’s notice of appeal was filed on December 9, 2002. Her response to this Court’s show cause order does not show sufficient cause, and we thus order her appeal dismissed.
