NO. 24927 IN THE SUPREME COURT OF THE STATE OF HAWAI#I DARSTON EDDINS, Plaintiff-Appellant vs. J. STEVE MORRISON, M.D., Defendant-Appellee APPEAL FROM THE THIRD CIRCUIT COURT (CIV. NO. 98-494) ORDER DENYING MOTION FOR RECONSIDERATION (By: Moon, C.J., Levinson, Nakayama, Ramil, and Acoba, JJ.) Upon consideration of appellee s motion for reconsideration of the May 30, 2002 order dismissing appeal, the papers in support and the record, it appears that Civil No. 98494 is not a single-claim circuit court action, but is a multiple-claim action that asserted claims of medical negligence and negligent infliction of emotional distress for which appellee Morrison moved for and was granted summary judgment on all claims and causes of action. Therefore, IT IS HEREBY ORDERED that the motion for reconsideration is denied. DATED: Honolulu, Hawai#i, June 13, 2002. John S. Nishimoto and Patricia T. Fujii for defendant-appellee on the motion
